Pathway Terms of Service

These Terms and Conditions (“Terms”) govern your enrollment in and use of the Pathway online program (“Program”) operated by © 2025 The Pathway by Alex Eubank (“Company,” “we,” “our,” or “us”). By purchasing or accessing the Program, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Enrollment and Access

Eligibility

You must provide accurate and complete information during enrollment. Enrollment may be denied or revoked if false or misleading information is provided.

Access to Materials

Upon successful payment, you will receive access to Program content, community, and coaching deliverables as outlined in Section.

Access duration and level are determined by the offer purchased at the time of checkout.

The Company reserves the right to:

• Update material
• Replace modules
• Add or remove calls
• Adjust deliverables

as part of ongoing program improvement and content relevance. No such updates shall qualify as grounds for refund or complaint.

2. Included Deliverables

Enrollment in the Program includes the following core educational deliverables:

2.1 Curriculum

Prerecorded modules covering topics such as:

• Branding
• Affiliate setup
• Business backend (entity, banking, processors, PayPal, compliance)
• Content Creation
• Scaling systems, dashboards, metrics tracking
• Paid Collaborations strategy
• Fulfillment, tax considerations, and automation

2.2 Tools & Templates

• Scripts and outreach templates
• CRM pipeline templates
• AI script generator

2.3 Community Access

• Private community
• Peer networking
• Access to discussion, collaboration, and resource channels

Opportunities shared by community members are not program deliverables nor guaranteed

2.4 Group Coaching

• Live coaching calls up to five times per week
• Guest trainings when available
• Call replay archive

2.5 1on1 Coaching

• Strategy and accountability calls based on the tier purchased
• Calls must be scheduled and used within the timeframe provided

3. Bonus Opportunities (Not Guaranteed)

Some elements of the Program are discretionary bonuses and not part of the paid Program value, including but not limited to:

• Brand deal consideration
• Internal brand partnership introductions
• Opportunities shared by members, brands, partners, or affiliates
• Networking outcomes

Clarification of Brand Deal Support

The Company may provide:

• Education on how to secure brand/UCG partnership opportunities
• Templates for outreach and agreement drafting
• Example contracts and case studies
• Documentation of past deliverables
• Access to or introductions within community spaces where opportunities may exist

The Company does NOT guarantee:

• Placement
• Retainer income
• Brand deals
• Paid opportunities
• Frequency or continuation of opportunities
• Earnings, commissions, revenue, or results
• Platform approval (TikTok, seller, ads, banking, processors)

Any agreement is solely between the student and the external brand. The Company is not a party to those agreements and is not responsible for fulfillment, payment, legal disputes, or continuation.

4. No Financial or Performance Guarantees

The Program is educational. Results depend on your:

• Effort
• Consistency
• Work quality
• Communication
• Market conditions
• Platform policies and restrictions
• Creator responsiveness
• Industry changes outside our control

We do not guarantee:

• Sales
• Income
• ROI
• Client acquisition
• Account approvals
• Retainer deals
• Future platform eligibility
• Any specific performance outcome

5. Intellectual Property Rights

All Program content and materials are the copyright of the Company.

You receive a limited, revocable, nontransferable license to view content for personal use only.

You may NOT:

• Share logins
• Resell or distribute content
• Record sessions without permission
• Publish internal resources
• Create a competing offer using Program material

Violations result in immediate termination without refund and may result in legal action.

6. Payments, Refunds, and Chargebacks

Payment

You agree to pay the full Program fee. If using financing, you authorize the processor to collect payments as scheduled.

Refunds

All sales are final unless otherwise stated in a written refund policy.

You are not eligible for a refund due to:

• Perceived lack of results
• Lack of time or ability to complete the Program
• TikTok, payment processor, or platform account issues
• Bonus opportunities not being offered or awarded
• Business changes or personal circumstances

Chargebacks

A chargeback after receiving access constitutes breach of contract.

Company may provide:

• Login records
• IP logs
• Support interactions
• Call attendance
• Download and access history

To dispute and overturn fraudulent chargebacks. You agree to attempt resolution with the Company before initiating a chargeback.

7. Communication & Support

You consent to receive email and SMS related to your enrollment.

Support response times vary and are not guaranteed.

Missed coaching calls or delays in communication are not failure to deliver the Program.

8. Platform, Industry, and Policy Risk

The digital business environment changes rapidly. You acknowledge that:

• Algorithms on social platforms and thirdparty tools control approvals and policies
• Platforms may ban or modify rules at any time
• The Company does not control these platforms

Such changes are not grounds for refund or dispute.

9. Suspension or Termination

The Company may suspend or terminate access without refund for:

• Abuse, harassment, or defamatory behavior
• Sharing internal content
• Encouraging chargebacks
• Misrepresentation or fraud
• Violation of these Terms

10. Media Release

You grant the Company permission to use testimonials, wins, screenshots, or feedback shared voluntarily. You may revoke this in writing.

11. Governing Law

These Terms shall be governed by the laws of the State of Florida.

Any disputes shall be resolved through arbitration in that jurisdiction.
